2. Description of Services
Namho Industries provides digital marketing services including, but not limited to, search engine optimisation (SEO), Google Ads management, social media marketing, website design and development, content marketing, and local SEO. The specific scope, deliverables, timelines and fees for any engagement will be set out separately in a proposal, quotation, or agreement shared with the client before work begins.
3. Client Responsibilities
- Providing accurate, complete and timely information, assets and approvals needed to carry out the agreed work.
- Ensuring you have the rights to any content, logos, images or trademarks you provide to us for use in campaigns or on your website.
- Maintaining ownership and access credentials for your own ad accounts, domain, hosting and analytics platforms where applicable.
- Complying with the advertising policies of platforms such as Google and Meta for any campaigns run on your behalf.
4. Payments
Fees, payment schedules and any advance or retainer amounts will be agreed in writing (via proposal, invoice or contract) before a project begins. Unless otherwise agreed, invoices are payable within the timeframe stated on the invoice. Any third-party costs such as advertising spend, domain registration or hosting are billed separately or paid directly by the client, as agreed per project.
5. Intellectual Property
Upon full payment for a project, ownership of custom deliverables created specifically for the client — such as website code built for them, original written content, and campaign assets — transfers to the client, except for any third-party tools, templates, stock assets or licensed software used in the process, which remain subject to their own licensing terms. Namho Industries retains the right to showcase completed work in its portfolio unless otherwise agreed in writing.
6. Confidentiality
Both parties agree to keep confidential any non-public business information shared during the course of an engagement, and to use it only for the purpose of delivering the agreed services.
7. No Guarantee of Results
Digital marketing outcomes such as search rankings, ad performance, traffic or sales are influenced by many factors outside our control, including market conditions, competition, and platform algorithm changes. While we work diligently and use industry best practices, we do not guarantee specific rankings, traffic volumes, or revenue outcomes.
8. Limitation of Liability
To the extent permitted by applicable law, Namho Industries shall not be liable for any indirect, incidental or consequential loss arising from the use of our services or this website. Our total liability for any claim relating to a service shall not exceed the amount paid by the client for that specific service.
9. Termination
Either party may terminate an ongoing engagement as per the notice period and terms agreed in the relevant service proposal or contract. Fees for work completed up to the date of termination remain payable.
10. Governing Law
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts at Ghaziabad, Uttar Pradesh.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of this website or our services after changes are posted constitutes acceptance of the revised Terms.
